Tata Wins The Battle Against Kejriwal Government In Delhi High Court

In order to promote the purchase of Electric Vehicles, the Delhi Government has implemented subsidies to all consumers who want to buy an EV where the consumers can have discounts on prices while buying an EV.

The government had made a list of electric vehicles which were eligible to come at a subsidized rate.

But, recently it removed India's most popular Electric Vehicle the Tata Nexon EV from the subsidy list.

Before this move, buyers who bought this car got a discount of almost 3 lac rupees under the subsidy scheme.

The move came after the incident where few customers lodged a complaint against the vehicle.

The complaints primarily accused that the vehicle wasn't delivering the promised range as claimed by the company.

Just due to this, the Delhi Government has decided to exclude the Tata Nexon EV from the subsidy list.

The XM variant of Nexon EV had a concession of about 1.49 lac rupees on-road and registration tax and the XZ+ variant of the vehicle had a concession of approximately 1.49-1.5 lac rupees.

The total discount applicable for both models is approximately 3 lac rupees.




In response to the action taken by Kejriwal Government, some officials of Tata have stated that it is very unfortunate that the Kejriwal Government has excluded the Tata Nexon EV from the subsidy list.

The officials also told that they determined the range only after certifying it from the Automotive Research Association of India (ARAI) under the AIS: 140.


Recent Updates:

As obvious as it seemed, Tata was not satisfied by the statements given by Kejriwal's Government for defending the action and it approached the Delhi High Court.

In the court, Tata expressed how the government had taken extreme steps just by the complaint of few customers without even looking deep into the matter of giving a chance for Tata to defend their Nexon EV.

The company also argued that in comparison with a handful of unsatisfied customers, they had thousands of happy customers who found the car perfect and loved it.

The company made a closing statement that Tata will be always ready to serve its customers and takes not feedback/complaints seriously.

It also said Tata Nexon EV is the only SUV under the personal-segment which follows the most number of criteria for assuring quality and does follow all the standards that are set up by the government for an Electric Vehicle.

The Delhi High Court was quick to make a decision and stayed the Kejriwal-led Delhi government's decision on banning subsidy for the Nexon EV.

The court said regarding the concerns for range offered by the vehicle that the current eligibility criteria for the range of an EV in India is at least 140km.

And no customer reported that the vehicle couldn't even complete a range of 140km. This single point is enough to prove that the action taken by the government is not valid.



The judge even said that the performance of the vehicle depends upon many factors which usually varies a lot from the testing grounds to actual usage.

Some of the primary factors mentioned are road condition, driving condition (How the driver drives the car), traffic, excessive usage of Air Conditioners (ACs), etc.

Regarding the reports given by ARAI, the conditions in which the test was conducted have a vast difference from the conditions of real usage. As petrol and diesel vehicles vary in their range, the same is applicable to electric vehicles.

In fact if any action has to be taken, it must be towards changing the current standards and rules set up by the ARAI for testing the range capabilities of the vehicle.

The Delhi High Court passed the suspension order for the action taken by Delhi Government without much investigation.
